Even during the recess, we were talking to the staff of a ton of senators. Most of the time the senators' staff are interested only if someone from 'their constituency' is also affected. We always say we have a ton of folks from each state, but nothing works like a real example.
For example, when we speak to say Senator Kennedy, it helps us to present the story of folks affected by retrogression and living in say Boston, MA. That way, the staff has some incentive to look into this and get hooked immediately.
Since time is short this time, we need all the stories from each state to make our case.
As promised, we will not reveal your story to media if you do not want to.
Though there is no harm to reveal one's name in media as can be noticed by the folks featured in the Roll Call article, Philly Inquirer and News Observer.
We will just concentrate on the crux how you are suffering because of delays such that even if your boss reads this story, he will not be offended or put off (Read our members stories in the three articles I have mentioned, none of it can get the IV members in any trouble at all).
At the same time we understand that you might have reasons to remain out of media and we will fully respect that.
But please send in your stories so we have a convincing story to make our case.....

According to DHS statistics there are around 50,000 EB2 lndia Labors in 2004 and 2005 each. So ppl with 2005, 2006 priority dates you can wait around 6-7 years for ur priority dates to be current with annual limit of around 5000 for EB2 India

Are we still compiling or the stoires have started going out to the right people. It was amazing to watch Sen FIenstein talk about a poor hardworking undocumented worker in the US. She was so eloquent. Every passing day makes u feel more like a 2nd class citizen. Anyways, let us chug on. I had sent my story. Dear friends, as I read all of your stories, I cannot help but relate it to mine. Even as I write this though, I am in the middle of a dilemma - I am being offered a promotion to a Director position and I cannot decide whether to accept it or not.
I have been in the US for over eight years on an H1 and have been working for a Fortune 20 firm as a Manager for the last four. My company applied for my Labor Cert back in Dec 2002 and while it cleared State in May 2003, the application was stuck in Federal processing for more than a year. Just as it seemed like they were getting to applications that had been transferred in during May 2003, the BEC took over and I literally felt like the rug had been pulled from under my feet! It's been almost two years since then, but I have seen no progress at all - zero, nada, zilch!
Meanwhile, I have been working hard at my company sorting my way through leadership changes, reorgs and changes in vision and strategy. While all of my colleagues and friends were applying to new positions and getting promoted, I lay low. Four years in the same job - I can tell you that is a looooong time! It isn't just that work starts to become a drag but also life itself seems to be in limbo and the frustration of the wait starts to spill over into personal life.
I got married two years ago and my wife, bless her heart, has been making a valiant effort to keep busy and pursue other interests, since she is on H-4. However, I know she can't wait to start working.
As all of you know, it takes a lot to succeed in the US economy and be recognized, but I have worked hard. Not only have I paid taxes for 8 years, but I also feel like I have paid my dues. I have an MBA from a top b-school and skills that are in demand. I cannot help but wonder, whether we are meant to waste our lives away?? You start feeling like a second-class human. I know I can always go back to my home country but I have invested a lot of my life here. We need justice!

I have no words for people in this forum, suggesting the person to just be quite and not report about that nanny who has harmed a child who is just 8 months old...it is very sad, sickening, and shocking that a majority of you guys are giving such bad suggestion.
Your first instinct as a parent is to protect your child.
If the child is harmed and you have the proof, man!!!! I would not be discussing that on this forum, but would go straight to the police station and give the complaint and protect my child and scores of other child who might be next if that nanny is not booked by the authorities.
She has advertised in a web site. It not going to be a big crime if you unknowingly hire someone who happens to be not authorized to work. At most its a misdemeanor with a fine.
But keeping quite after seeing what that devil has done to a child, it really bogs my mind, can't imagine why you folks are so afraid.

We have had similar experiences in Southern California as well. We are about a group of 10 - 15 ppl. in so.cal who actively take part in the action items and contribute inspite of having 113 registered members in the chapter. We recruited over 200 newbies in the past three events in southern california. Let's see if we can get all of them to register and get active

Does LUD on I 140 necessarily tie to 485 receipt generation? I don't think so - why would they touch the already approved I 140 case to begin processing 485? Unless I am missing something...
My I 140 has been approved in Feb 07 from TSC and 485 application was mailed to NSC on July 2nd. No LUD on 140 and no 485 receipts yet...

I beg to differ. IV is not turning away anyone. What stops someone from contributing $100 once every 10 months?
The issue is something else.
In order to contribute even $10, you need to:
1) be convinced about the cause of IV
2) be convinced this organization means business!
3) give up the "penny wise pound foolish" attitude
(1) This should be easy for those who were unable to file their AOS applications in July/August 2007, because one of IV's primary goals (abolish retrogression) should then be your goal.
This is also easy for those who filed their AOS, if only they realize that "working on AC21/EAD" is not as much fun as it seems, you really need the Green Card to live and work the way you want!
(2) is a proven fact, and most of us are already enjoying the benefits of this!
(3) Finally, people feel overwhelmed by the thought of donating $50 or $100 to IV but they are happy to spend much more on gasoline, phone-calls, and drinks. You make no difference to your quality of life when you spend $50 on gas and $100 on food when you go sight seeing on a weekend. But when you donate that money to IV, you are supporting the one and only grass roots organization that means business when it comes to fighting for your own quality of life!
It's like investing in a "credit score" monitoring product for a year before you actually apply for a loan!
If that analogy makes sense, please please realize you need a similar strategy for your green card, and contribute to IV.
Preferably, sign up for recurring contributions, as this is the one thing that will help IV in forecasting and planning.

I had 2 soft LUDs in Aug 26 and 27 in 2008 for all of 3 applicants on that day not sure they are for what..that time I was in India using AP.
Another guess is my file may have been pre-adjudicated thats why I had see 3 LUD's as other 2 applicants didn't treavel to India only myself.

Thank you for your initiative. After the raised and dashed hopes over the past 2-3 months (August, Sept & Oct 2008 visa bulletins) I am BLOODY angry about this RIDICULOUSLY fecked up system!!!!!!!!!!!!!!!!!!! Why the hell am I subjecting myself to this indignity!!
Here is a letter I drafted that I'd like to send to the Ombudsman .. could you'll help me edit/revise the content and also, please provide me with the contact info for the ombudsman?
we could also write letters to highlight this to Congresswoman Lofgren as well as publish it in media outlets?

As a result the DOS either under- or over-estimates the number of applicants available for adjustment of status. When the date moves forward by too large a window, USCIS tends to approve the more recent applications as opposed to the ones that were filed earlier. Let me explain with an example: in the July 2008 visa bulletin, the cut-off date for the India EB2 category was 01 April 2004. A month later, the cut-off date for Indian EB2 applicants abruptly moved forward two years and was set at 01 June 2006. Instead of approving applicants who applied in 2004 and 2005, USCIS approved applicants from 2006. Where is the justice in that???
Indian employment-based immigrants are tax-paying, law-abiding, educated individuals contributing to America�s knowledge economy - yet we have been subjected to the worst aspects of the US employment-based immigration system. These include:
1) Extended wait times at each step of the immigration process.
2) Lack of transparency on the part of USCIS.
3) Lost opportunities owing to the lack of job portability during the process (a time period spanning an average of five years, whereas an applicant from any country besides India gets his/her PR card in under two years).
While we are grateful for the opportunity to partake in the American dream, it is ironic that we arrive in America and find that our freedom is shackled � we are bound to our sponsoring employer from the start to the end of this extremely lengthy process. Although legal immigration reform is our ongoing aim, for now, we sincerely request you to investigate the process whereby the monthly visa bulletin is set and to ensure FIFO (first in, first out) adjustment so that those of us who have been waiting longer receive attention prior to those who have applied later.

Cant repeat this enough times.... you guys rock !!!!!!!
I mean, its one thing to see it happen in the movies but this group has taken on Goliath and has won a major battle. There is still a long road ahead but the combined efforts of lobbying, rallies and the flower campaign (also the threat of a lawsuit, cant forget that one) has brought fruits to our efforts. pappu, Logiclife and all others of the core group, hats off.

I completed my MS in Computer Science from US around 6 years back, was on OPT for a year & thereafter moved out of US and came back to my home town. Have been working here for 6 years now as in the software field & have now applied for H1B under masters Quota. Was wondering if I am eligible to apply under this quota as I am neither a fresh graduate nor have any status in the US. Also, my lawyer has only filled out the I-129 form. Is there any special form that needs to be filled out to be considered for Master's quota?
