I hope you are not joking here, did you try to port your EB-3 date to some old PD or change from EB-3 to EB-2?
I am surprised how come PD is not current and USCIS denies I-131 based on the grounds that I-485 approved.
Something is definitely wrong here, unless its USCIS system glitch which considers the preadjudicated (pre-approved) cases as approved and then deby subsequent benefits associated with AoS (I-485) pending application.
Very interesting news for the IV community. Keep us posted on the new developments.

Your comment reminded me of something I had penned down right after Prime Minister Manmohan Singh visit to the US. It was very depressing.
A White Collar Slave
Prime Minister Manmohan Singh�s visit to the White House was well reported in the media and the Presidents acknowledgement of the contributions made by the people of India- Indian American�s was most gracious. He also made a point to acknowledge the contributions made by Indian students to America�s Universities. All this is most heart-warming. However, as a legal non-permanent resident awaiting labor certification (or the ability to work) since the past 3 years I feel bound by invisible chains whose cold steel refuses to be warmed. The labor certification process is technically supposed to take 12 months.
Post 9-11, grinding to a near halt the labor certification process of permanent residency applicants is a �win-win� opportunity for the government. Get these highly skilled laborers on a short-term lease of an H1B. Pass off the bureaucracy and red tape of the INS on the process of Homeland security. The latest breakdown, the INS information technology system has been down for 6 weeks now. When asked questions about a status of the system, they donot respond
HIB visa holders make money in dollars that certainly affords them a higher income than would have been possible in their own country. I donot want to undervalue this benefit. But, the American government and citizens hugely profit from the brief stay of these H1B�s in America. H1B�s make money, 99% of which is placed in American banks, which enables banks to fund American projects of citizens and noncitizens. They buy American stock, pay into a social security system and a pension fund that the may not have access to when they themselves are seniors- after all the H1B is only for 6 years. Besides the obvious monetary contributions, they contribute culturally, linguistically and through charity to American society
While they are contributing in as many ways to the American society. Their own lives are in limbo. Continuously stressed over the next rule change in visa status that may affect them, or visiting relatives. Their able spouses unable to work due to visa restrictions. Most of them, live in clean, minimal living comforts as there is always the thought of having liquid cash as one may need to leave the country and then having expensive electronics, cars or furniture may not make any sense. For most of them it does not make sense to own a house on a 6-year work contract.
The opposing argument is that HIB visa holders are subjecting themselves to this lifestyle. After all there are no visible chains around their feet, they are free to return and contribute to the economy of their own countries. But the �American dream� is an invisible chain currently held by INS merchants as they pull, push or decide to hold steady their white-collar slaves.

I got an LUD on 485 when i got AP approved.
Dont even try to rationalise how the f*** those systems are inter connected and how they roll :o
Same with me. I applied for AP and got it approved on Feb9th. On Feb10th, I got soft LUD on mine and my wife's 485. I was hoping thats pre-adjudication, but I have my doubts now. They just probably are checking my 485 at the time of AP approval. :(

Moderators, do you think it's possible to issue an email receipt to contributors? I donated $250 so far and the first $100 was done through my bank billpay.. However, the online billpay deducted the amount right away, and it didn't give me any indication whether the check was actually endorsed by the intended recipient on the supposed delivery date.. Worrying about that, I sent in my second contribution via paypal.
Writing an actual paper check, I would see a copy of endorsement online, or using paypal I would know it's cashed out via email. But this is not the case with my bank's (bank of america) online billpay. Thanks!

We need active participation from members for the action item listed on this thread. CHC member are taking a very hard stand on the 3 bills introduced by Lofgren. If members (esp. constituents) don't call in large numbers and urge the CHC members to support the bills. The 3 bills may not even see the house floor. CHC members want only one immigration bill (CIR), nothing else is accepted.
Please ask u'r friends and colleagues (who are constituents of CHC lawmakers) to participate in this crucial action item.

Was the H1B through a body shopper? I"ve heard of reopening all old cases of a company if they find a dubious H1B sponsorship, or if a company gets blacklisted.

So How come all we hear from the core team is requests for contribution? There is no detail of any actions/efforts that are happening currently? It will certainly be more engaging for all members to at least know what efforts are being worked on currently? I think expectations need to work both ways otherwise you just have an autocratic organization that has to follow and do as the leaders choose to do. Just my 2 cents and all you frustrated folks please take a deep breath before jumping in.

Thats true. In my case PD March 2005. Waiting for a chance to file my I-485 but whoeever has PD 2005,2006,2007 all have their EADS.

-AILA and others had been and are are still trying to oppose this rule as it benefits them and their clients (employers).
-Labor substitution has been abused and has given a bad name to the GC process.
- Lot of desi companies have become notorious for selling it. Some of them were brave enough to sell it online on sites. Iv condemns any kind of misuse of the system and breaking of law.
- A lot of labor certifications coming out of BECs continue to be substituted. This has caused more delay in PDs moving forward.
- The 45 day rule to use the LC will force employers and Lawyers to work quickly on the application. Lawyers are known to be slow in filing process so they will need to change.
Lets hope USCIS, DOL and DOS make further changes in their regulations and the process is better suited to reduce the pain for applicants. FBI Name checks, long wait times in various steps etc are also worth reforming. On various occasions IV has drawn USCIS attention to various items in the greencard process that need reform. IV will continue to raise all such issues that hurt our members with media, USCIS and lawmakers.

I submitted usps money orders for I-485 fees. Filed on july 2nd.
Any way to find out if those money orders are enchashed or no?
I did try google search and so far no answer.
i did the same, because i thought that what my lawyer wanted.
The only way to track tme money order is after 60 day from bying it. You can go to the post office and they will invistigated. it cost 5 dollars. They wont do it before 60 days. i went and asked.
