    USA has a right to choose who they give green card to but not fool Indian people by swinging visa bulletin by 4 years every now and then. Not by discriminating. There should be some transparency to the process and law should be followed. If USA makes a law that Indians wont get GC in EB, I am happy to note. Can they remove their gloves?

    IV now has clout which should be immediately used for a permanent fix. Two issues which might not require laws being passed can be implemented to ease the backlog situation that will be created.

    1. Recapture lost Visa numbers- A just and reasonable demand that they cannot refuse.
    2. Remove per country cap- It is stupid to look for diversity in a category based on intellect. The whole category is created for improving America's brain power so a country cap does not make sense.

    Which is better to say" We want 10 people with OK intellect from 10 different countries of the world" or " We want 10 absolutely brilliant people-period"
    If a country has more than 10,000 qualified people then approx. 10 of them will be super intelligent! This has to be true. In addition diversity adds to different ways of thinking and is the reason for soft quota for MBA admissions. Hence, diversity quota will be there. The only thing we could ask for to assign diversity score for each country. For example, India with 2000 languages is very diverse compared to other country say Iraq. Hence every country should be allocated quota based on their diversity score.

    Below is the text for Waivers.. My understanding is that if end Client gives a letter to DOL stating that they don't layoffs due to this H1B and it is a temp. labor requirement etc.. It is still harsh considering anti-immigration climate.. What is feared asked in a Visa interview will be asked by DOL for extensions. So, H1B can't be on an auto-pilot mode..


    ``(I) the employer with whom the H-1B nonimmigrant would be placed has not displaced, and does not intend to displace, a United States worker employed by the employer within the period beginning 180 days before and ending 180 days after the date of the placement of the nonimmigrant with the employer;

    ``(II) the H-1B nonimmigrant will not be controlled and supervised principally by the employer with whom the H-1B nonimmigrant would be placed; and

    ``(III) the placement of the H-1B nonimmigrant is not essentially an arrangement to provide labor for hire for the employer with whom the H-1B nonimmigrant will be placed.



    the big consulting companies (IBM/Deloitte/Accenture et al) will try to get a waiver by showing the 3 conditions above - however, they need to do so every time a current assignment for their H1B employer ends and they need to place them on a new assignment / client. At that time they need to go through the waiver again, to determine whether the end client has had any layoffs in the last 180 days.

    In short this bill is a disaster for ALL CONSULTING companies that have a large H1B population.

    I didnt know you have such doubts about the efforts of IV and its goals.

    Anyways, have you every picked up the phone and called us to ask us what we are doing at that moment? What we did last week, what's our plan next week? You know, there is a phone number listed at several places on the website. That phone never rings. Oh yes, never. So who come you never seek answers where you can get them?

    We have told several times, that we dont have time to keep everyone in loop about everything we do in DC, including every time we meet some staffer or someone. Sorry, that's just how it is.

    Last week, Aman was in DC on Thursday and Friday (Jan 25 and 26) and had meetings with 3 senate staffers who work on Immigration. Then he went to India, then he came back straight to DC monday morning and since yesterday, he has met with 2 more staffers, our lobbyists.
    We are also trying to find out about the schedule A rumor and if its true, to have the recaptured visas go to all categories not just schedule A.

    So there, you have your update? If you want to know more, then call us on the phone.

    And this update is the kind of update we dont usually post on forums. This is mundane advocacy stuff. Find me one organization that gives hour by hour update of what they are doing.

    If you dont trust us, what are you doing here. Why dont you join the "bash IV" party at immigration portal and enjoy criticizing the arrogant IV core and its stupid blind followers. I am sure you will find many enlightened fellows like over at portal who are smart enough not to follow or believe in IV.

    Calling us in not the solution. After you call us and get an update, tell us how you can help us and then actually help us.
    Purplehazea, lets see if you now step up and come forward to help us in our efforts instead of ranting about us.
    If you are one of those members that were once part of IV and either got banned or left because you felt we are working against your interests, then you were never part of this community and effort. This is a genuine effort and a lot of people's careers and personal lives are affected due to the greencard problem and we are genuinely trying to fix it. If you are trying to spread a negative message urging people not to contribute and posting negative remarks, then you either are not affected by retrogression (and so you dont belong here) or you are so naive that you are hurting your own interests by posting negative remarks on other forums.
    Lets also see how many members are willing to come forward to actively work for IV and also contrbute for the cause.
    lets also see how many H4s come forward to volunteer their time for this effort. We are on H1s and find it hard to manage our jobs and IV work. H4s can be a great asset in our volunteer efforts on various fronts.
    lets see if there are any H4s who can commit to meeting each and every lawmaker in their state. Lets also see if there is any H4 in DC area who can commit to spend some hours daily meeting staffers in various DC offices and doing the running around work that some core members do by travelling to DC on their own money and use up their entire vacation time.

    If you do any of the above, then come back and tell us what to do and what not to do. Give us all your ideas and suggestions and ask us to execute them for you. Then tell us that we are arrogant etc etc. Then tell us that you can do better than us and lead all of us. We are very open to this.

    My wife and I had our interviews on Jan 3rd. Consulate handed the passport to VFS on Jan 4th. DHL (i think) delivered at home on Jan 5th.

    Donor forums is not to close the doors. While many non-donor members are stilling in search of excuses for not contributing donor forum is providing open vast potential for collaboration within serious people for serious cause of getting GC.

    There is no need for getting disappointed... start contributing for your own good. Once you are in donor forum you will get up to date information.

    The issue here is very specific, both pappu and I have told you what we think and attempted to explain why we do not want to invest resources in a specific action you suggested. Given that I can't spend the hours needed to explain the last few years of work and experience on this issue, I doubt this discussion will go anywhere. Feel free to send the fax. Just accept that we are not going to promote this as a mass action right now for many reasons. Peace!

    Paskal, You are right - I do not understand. But mostly I cannot understand because as an organisation - you do not explain.     I have often seen threads on this site that have members complaining that IV is not doing anything - to which invariably the response is that one should join the donor forum. On the other hand we get newsletters from admin that ask up to tighten our belts etc. - and get more involved. Well, that cannot happen unless IV provides more updated information on what IV is actually doing, veiled references to behind the scenes activity and years of hard work are not enough to involve all those who have signed up here to become 'more involved'.

    As for this discussion going nowhere I could not agree more - you see to have an open discussion or indeed debate - there must be at least 2 willing participants. And since you have already decided that you do not have time for the Qs of a mere non-paying member of this forum, I do not expect any better.

    By the way, the way ahead is not to close doors, but to welcome questions and encourge those on this forum with curiosity to be more active. More often than not, I have seen that those who Q on this forum, are mocked, ignored, and treated as if they are wasting CORE's time. Sad for a forum that hopes to involve a wider audience in this issue.

    Believe it or not, I know a consultant who lives in one of those "guest houses" where consultants who come from India are housed, and there is a guy who lives there whose job is to cook, clean and buy groceries for the housmates. HE HAS A GC APPLICATION PENDING! And people like me and many others who truely deserve to be hired and retained in this country are facing an uphill task of getting through the GC process.

    That cook guy came to the US with a Bachelor degree in commerce, called B.Com. He hasn't been able to get a project for 4 3 years now. He doesn't get paid by the company. He is just a freeloader living there.

    Imagine how many suck "cooks", "maids", and gas station employees might be out there clogging up the system!
    I don't get this. Who is sponsoring this person's GC? He must have a sponsor to get the EB-based GC. He can't show his job skills as cooking !!:)

    Salient features of Bill: S.1085

    After analyzing this bill, I found the following:

    1. This bill will recapture all those unused employment based visas (gcs) from 1997 till 2008 and it will add those recaptured visas to this year's employment based quota.

    2. After the passage of this bill, any unused visas will rollover to the next year. So, no more wastage of visas as we go forward.

    3. Per country limit will be increased from 7% to 10%, so more folks from over subscribed countries would be able to come under the normal yearly quota.

    4. We will be able to avail the benefits of the recapture after 60 days of the passage of the bill. That means, if they are able to recapture 220,000 (approx) employment based visas, the employment based category will be able to use all those after 60 days of the passage of this bill. USCIS is pre-adjudicating all I485s pending and if this bill gets passed in say for eg by October 30, almost all (80%) in this community (who filed 485) would be able get their GCs in Jan and Feb of 2010.


    What makes this bill much more interesting is:

    1. This is not a bill targetting the issues of Employment based category - So there won't be a huge backlash against this in the name of the economy and recession. The provisions for the employment category are just one item in this bill.

    2. Family based immigration reform has a wider range of support from all kinds of groups unlike Employment based immigration reform. Just search for this bill "Reuniting Families Act" in google news and you can identify all those organizations supporting this bill (they all have a news release).

    For that matter nothing is an achievement. if Some one gets a baby everyone greets him. Is that an achievement? If you buy a house you are happy. Is that an achievement? For some people coming to US was an achievement. Some people think getting a green card. We see all congratulation message when someone get his GC.
    So Please be broad minded. It may be nothing for you. But for some people it is an achievement. People like me are happy by achieving small things. This may nothing for you But it is good reason for the celebration for the people like us.
    Great achievement . Guys are not able to get GC in 10 years and this guy has got Citizenship in 10 year.

    I am sure it is, I am a CP candidate, till now AOS dates mirrored CP dates and vice versa, so this time also it has to be true!!! Usually consulates get the dates b4hand from DOS, as they have to schedule interviews. I hope I'll be scheduled for the interview this april.

I have applied for 485 and my PD is 2006, so out of question my date will be current soon but i would like to go back to india to take care of my parents and then when my PD is current I can come back.

    I understand where you are coming from. And I am sorry that some of my recent posts were irresponsible.

    Frankly, after mumbai attack I have been a different person. I come to this forum to learn and provide any information I can provide. But it bothers me to see few jerks like mirage who don't have any clue of how things work, and they just start posting on the forum "remove country limits, remove country limits, remove country limits, remove country limits, remove country limits, remove country limits, remove country limits" 30 times a day, as if that will be sufficient to remove country limits. And in more ways this uneducated style bothers me. I will try to ignore it and go my way.

    I am right now going to speed dial that other side of me, good and informative side.
