Boy, you are two kinds of crazy
1) You ignored the point people have life and do things to be happy in life. You choose a job that makes you happy. Then apply for GC either EB3 or EB2.
You say you have chosen PHD, and you came out low on money. What were you smoking when you chose Phd and also thought you would make money?
2) I cannot change my classification and port it like it is my application. Because simply it is not. At the same time I do not want to leave my 6 figure job with benefits ( yeah you heard it right and damn right I worked hard for it like you did for your Phd)
And yeah India is a great country and would love to go back someday, but not today. Irony is I know for a fact that I will have better life in India than in US given my family background. But I will not let any struggle in my life go waste.
PS: I have a US Masters with a 4.0. I have got offers for Phd which I chose not to do because it does not interest me.

Now if i begin lamenting that I am qualified for EB1 which is current and life is unfair since i am in EB2, how much sense would that make? My point is Don't crib if EB3 is retrogressed...use the system and become EB2, port your priority date, which is ofcourse dependent upon finding an EB2 job !!! All of this nonsense .."i pray someone does something for EB3" is going to get no one anywhere !! Fight for comprehensive immigration reform or HR 5882 recapture BUT for god's sake Do not blame the EB2 - India people who have played by the rules and are in a favorable position today relative to EB3 !!
The lawsuit against PD porting makes sense from an EB2 perspective and they are right to go ahead with it. Porting your PD from EB3 to EB2 makes sense from an EB3 perspective and every EB3 should try to do it before this door closes, if it does.

Let us all have a rally to move back to our countries on 4July2008 to symbolically show that we want our Freedom and Independence and never return back.
If all the articles about reverse brain drain we are reading about is true they would do something to solve this GC situation. Otherwise the anti-immigrants will come to see us off while we depart this country and never to return back as H1B's trying to get GC's and live here. This will go into history, 30yrs from now and our grandchildren will read about it. And may be we will get some special pension at our home countries for returning back and helping it to do better.

Sen Grassley makes sense to me. It looks like he has thorughly studied the program. If he is really concerned to stop the abuse in H1B program then
a. H1B visa should be decreased
b. EB visas should be doubled
c. Current backlog should be cleared by recapturing visas.
If we are all on the same level playing field, then there will not be a chance of lower wages & the employers will only recruit based on true skills.
In either case, Americans need to be more competitive, rather than just crying that I am replaced by a H1-B. Why would any employer sponsor an H1B visa when he has equally qualified US citizen.
Hope the senator understands both the sides of the same coin, just reforming H1B will not help much. It will result in outsourcing. EB visas should be doubled.

Back in the days there was a campaign launched by Govt of India to plant more trees.....the slogan was "plant one tree for every house". A wise guy was prompt to ask the govt... "give me a house, I will plant a tree". Likewise, give me the GC, I will definitely follow the rules.

I am now waiting for October 1st, attorney said that they will send an inquiry through AILA. I am not sure if I should call USCIS now, as they tell me to call after 60 days based on the response they sent to the inquiry that was made by the local senator.
I also got a response for my 09/04 Infopass appointment today. It says "Based on the documentation you have provided, your cases qualifies for expedited processing. You should hear back from us within 45-60 days. If you do not hear back from us within 60 days, please call us back.
I have no clue what that means? I have not provided them any documentation in the last 2 years. LUD on my case is from April 2009 (when I filed for AP/EAD) and status update is for the document they sent to me for FP in September 2007.

It's not just 180 daysd before the application, it also includes 180 days AFTER the application.
This is the current section on 90 days period
(E)(i) In the case of an application described in clause (ii),
the employer did not displace and will not displace a United States
worker (as defined in paragraph (4)) employed by the employer within
the period beginning 90 days before and ending 90 days after the
date of filing of any visa petition supported by the application.
And the ammendment in the new bill
(1) NONDISPLACEMENT.--Subparagraph (E) of such section 212(n)(1) is amended--

(i) by striking ``90 days'' both places it appears and inserting ``180 days'';

Hey guys, thanks for the replies and the good advice, which helps a lot. It's true that prevailing wage for H1b and CG are different, so I don't think my employer is breaking the law...at least not yet. (Logiclife, what do you think? Wouldn't the attorney had told them that they are breaking the law?) It's just a hard reality check to realize that all the "we care about our employees" is just a smoke screen.

Long term USA bonds are toast. You can short them instead of buying.
Why should China/Taiwan/Arab get out of Gold? There are no strong indicators for doing that for now.
I cannot stop but laugh at your insistence that USA is global economic engine. More than half of the population is in deep debt and their population is ageing fast. Students can't borrow money now on easy terms to dund their education. THere is virtually no appetite for more debt to fire the economic engine at all.
Physical gold and silver is best to possess.
Equity is down 20% to 30% in developing world and 50 to 70% down in emerging world over 7 trading days, but gold/silver/platinum is just hanging on there, so get out of commodities which would not help you at all, best option is stay in long term USA bonds for security or buy south east Asia bonds which would be right choice for long term
