Actually, not all he said was wrong.
We should not support what these IT consulting companies are doing with H1B programme just because we are on H1. These big companies are hoarding H1B visas so they can have an upperhand when dealing with the employees.
My own employer was trying to get as many H1s as possible without having ANY work for them. They sent us all a few emails asking us if we had any family or friends back home who want to come to US on H1. These guys make the H1 applicants pay for the application expenses, then just keep them there or get them here and keep them on bench and almost everybody here is familiar with what happens next.
Think from an American's point of view.. It is THEIR country, THEY make the laws that benefit their society and economy.. they have all the right to stand up against these practices by foreign based companies..

I had found about 72 articles yesterday morning and we had more than 50 potential reporters to contact.It is not easy to get press coverage and this is one opportunity where we can captitalize on the venture captitalist story (no pun intentended).

They don't even know the whole story. Yes, all those years I had to lie, especially to my parents:I didn't want them to worry about me.

If thats the case then why did they reopen my new case which is from my current employer. The old case from previous employer isnt even touched. The previous employer was a desi company. The new employer is a US corporation with just 1 H1 employee.

DO NOT PANIC. These notices are usually sent when you have any H1 transfer pendings most of the time ( at least in case of H1). By law, the employer is supposed to notify USCIS whenever any employer has left the company.
The re-opening of case is a letter from USCIS to the previous employers to confirm that the employee no longer works and is usually sent to the attorney.
So chill and don't sweat.

My dad came to US in 1971 and got a green card at the airport under "Employment based 3rd preference category(For engineers, Doctors and Chartered Accountantss)" though he went back after a few years. Thats how they used to give Green Cards in those days. Lot of engineers, doctors and chartered accountantss migrated in the beginning of 70s. USCIS is not dumb...They have interpreted the law in the way they think is appropriate....They are applying the over all 7% country cap to China/India EB2 and sending the overflow to EB3 ROW..... It is not fair but it is not exactly illegal...The law is open to interpretation and USCIS has chose to select this interpretation......You can take a crack at suing the USCIS.....I doubt that you would get anywhere......The EB2 India/China might benefit from the lawsuit....But as you know not all members would agree on IV spending resources on this lawsuit because this serves only a small section of member population.... At a personal level you can gather a few EB2 China India guys and have a crack at suing USCIS....

My H1b (Revalidation for 7th yr) was on Dec 13th 1:45PM...Still hasnt receive my passport...Called the consulate ...they mentioned PIMS check is needed in order to stamp the passport...My travel date is Jan 9th..and I am also getting anxious...When asked about how long I will have to wait..they said to call back on Jan 5th (!!!????)...
Consulate apparently was on vacation from Dec 21st thru 26th..in US also until 2nd is pretty much 'holiday season' (lot of folks on vacation) (I hear this PIMS check is done by some system in Okalahoma)..
I hope I wont have to postpone my tickets...Looks like this system got kicked in Late Nov,Dec (Per Murthy)..May be we are the gini pigs..

It should show a lot of details about the employer and also as to who prepared the forms(attorney info if there is one)
As i said if the company itself has done the work themselves with a full time attorney...then the company is fully liable...if the company has hired outside attorney...the company is still liable...but the outside attorney would also be liable for building fake cases.
There is also a law that if the H1B employer has terminated your services before the estimated time your service was required then the employer has to pay you the transportation costs for your return home.

As I see it, the only persons benefited are the ones having the priority dates in ancient times. I think we really should not mind letting them have their GC's, being our seniors.
Yes, later year porters might end up having to wait. It's all in the game, fortunately or unfortunately. One thing is for sure, we as a whole, have an uphill battle
If it really comes to matter, I think it should be easy for an EB2 to port to EB3 if the dates are current for him in the different category. So if I were EB2 today, I wouldn't be so apprehensive :)

There can be several things that we want to discuss and share. But isn't this platform supposed to be for immigration? If we start discussing about Best phone cards, airtickets to india, jokes, unrelated politics etc., we will soon loose the purpose of this website and forum.
If many senators, attorneys, other aides visit this website and can find all this unrelated posts, we loose the seriousness and focus we would like to address.
Maybe core team can evaluate and see if they want to create a special section for general discussion that does not show on the front page. Just a suggestion.

How long will it probably take for China EB2 to move to August 2005? It's now in April 2005. Any idea?
