On the note of taking attorney for immigration interview...most of the well known immigration attorneys are too busy to attend such...they would send a senior legal assistant. Some of the senior legal assistants who work at firms for a few years are as knowledgeable as the attorneys and consult attorneys only on tricky matters...so in some cases even sr. legal assistants accompanying would help.

I believe if the case has been pre-adjudicated then it shouldn't matter whats the RD and ND. They will probably approve based on Priority date. Earlier PDs get approved first. But who knows, its USCIS.
dwuser's case does not seem to have been preadjudicated, as his/her ND is not within the published current processing dates by TSC. For preadjudicated cases PD should be the priority for visa issues.

If your PD was current, but they didn't give you a visa, that is a mistake. Why should someone report getting a visa is a mistake? He applied for the visa, he/she got it. Is it his/her job to watch USCIS? What future problems should he/she expect for getting a visa?
It is your choice but there were suggestions from attorneys that if GC is issued when PD is not current, it should be reported to USCIS to avoid future troubles. Search this forum for details. There were two threads disucssing this.
Further, it is great mis-impression that everyone who applies for a GC watches visa bulletins, or knows how they work.

I'm curious if the POE officers know if a person has been laid off? A friend of mine is planning to travel to Canada for the first time. He has an H1b for the past 6 years and approved I-140 and extension. He was laid off for 5 months from Company A but has an approved extension for Company B. This was 4 years ago.. His been working for company B eversince w/o problems.
His worried about traveling. His planning to use Auto Revalidation with his B1 visa. Can somebody advice?

Actually we were called for interview at the local uscis, : My RD was Aug-17-2007 and the ND is Oct-15-2007. The DAO - District Adjudication Offcier gave me a heart attack saying that we are not eligible for GC as the cut-off date was 17-Aug and we were out of the window. Then I politely explained her, and then she looked at the RD and said that we would be fine. Also I called USCIS last week, and told that I filed on Aug, one rep said that they go by ND, I called again and the other rep said that "by ND". Not sure, may be uscis itself is not sure.
Anyhow, is it advisable to take an infopass now (i.e) before september . Wouldn't it be better to visit uscis office in september, so that we could strongly say that "We are current, and could something be done about our case".
I'm afraid that, if we go to uscis now saying that "We will be current in Sep", the uscis people might ask us come back again in Sep. And remember, we cannot have two consecutive infopass within 45 day. So what do you suggest?

good work Sherman_tribiani, i am watching this group of "highly skilled job stealer� for sometime. they merely talk and do nothing. most of them r scared to do anything. they r scared of u & me. they r not scared when they steal our jobs and we will scare the hell out these ba$tard$ to make them do in their pants before we kick them out. gheen told me about this group and he also said that not to waste my time on these job stealers as they r weak and incapable of doing anything, other than stealing our jobs and outsourcing.

I am EB3-I (pd 02 retrogressed) but was interested in this discussion so i emailed my lawyer about it. She said, historically the last month of the fiscal year has the most approvals as they try to clear as much as they can. You will see a lot more approvals from next week or sept 2nd week.
.......assuming there are still remaining visa numbers. It so happened last few of years that USCIS was sitting on their hands until last month. Is it the case this year ?

I have seen lot of ppl wine about the Dec bulletin, inefficiency of USCIS, cursing IV, EB2 Vs EB3, exploitation by Desi Employers, leaving negative comments ETC. ETC.... but when it comes to just sending letters, they won't do it but some how they will manage to find the time to reply non-immigration related issues in very detail.
Therefore I request all the members to please send the letter (regarding AC21 Denial issue) ASAP.
BTW: As a father, I fully sympathize with this guy & understand his situation. Whatever happened to his kid is tragic but again as mentioned by few other members, he should have posted this issue on sulekha or some other websites.

Its pity that MOST CRITICAL issue we are facing at present - AC21 Denial issue, is having only 77 mails but everyone is jumping gossipping. Come out of this and show a unity to real problems.
Grow up and don't escape from real problems. Its our problem and we need to fight to resolve it.

If your "real" receive date (what you see online as "your case was received on...") is within the published processing dates for your service center, and your case is straight forward, most likely it is preadjudicated. In that case, as their SOP says, they put them in PD order in waiting for the visa. See the SOP below (which is a bit out of date). You are pretty high in PD seniority. you should get a good news soon. Best of luck.

Which center you case went to? Mine went to California service center ( CSC).

If he goes to cops what happens to his 485? He is worried that's why he is on this forum - I think he was looking for posters with similar experiences and whether complaining to cops worked or not.
