I wonder what this is going to fetch. Plus the idea that USCIS is going to call up CNN once they receive 50 flower bouquets is hard to believe, unless CNN goes flower-sniffing ;-) at government offices regularly.

I guess My interview didn't go as expected.
1) I reached the office an hour early.
2) After waiting,they did security check and let us in
3) Then the lady who was assigned my case, came and took us into her room
4) Oath, etc
5) She then started asking for Birth cert, Marriage Cert, kids birth certi, 140 approval copy.
6) Then she pulled a file (which was labelled DOS Visa bulletins) and spent around 15 mins on Oct 2007 bulletin.
7) Then asked us who filed your 485..you did your self or your employer did..we said employer.
8) Then she said, something is not right..per Oct 2007 bulleting Visa's are unavailable so yours was not filed properly.
9) Then I said, ours was filed in Aug 8th 2007. She insisted the receipt date is oct 2007..then we showed her our 485 reciept.
10) Then she thanked us and started looking at Aug 2007 visa bulletin. and said, even then in Aug 2007 EB2 was U, so yours was not properly filed.
11) I told her, There was an interim Memo released by USCIS that they will accept application until Aug-17 2007 based on July 2007 visa bulletin
12) She said she will look at DOS bulletins
13) After 10 mins she said, she cant find any such memo..and said, since there is no evidence with her, she has to deny our case based on "Improper filing when PD was not current"
14) Then I said, if PD was not current, wouldn't TSC return the application denying on the spot? Why would they accept the application?
15) She said, you would think so..but they accept many times..so we are told to verify all the time
16) THen said, she believes us but for process, she needs evidence and said she will look into further and then make a judgment.
17) We had no choice and we were over the interview. we were little disappointed though
18) After coming home, I realized she took all I-94s and we got panicked..because if 485 is getting denied and I-94s are gone, how do we prove our legal status, so we thought of going back..then I thought, if have to go anyway, then I should take a print out of Interim Memo

20) I told security that, we had finished our interview and officer forgot to return our I-94..they insisted that we shud take infopass and they wont allow anyone to go back..I had to really argue with them (I decided I have nothing to loose..anyway 485 is screwed and so stood there asking them to let me in)
21) After consistent nagging, the security guy took our passports, interview response letter(After interview if your app doesn't get appproved they willgive a kind of reciept saying u attended the interview..blahblah) and went in
22) Came back and told me to go in since the officer wants more details from you (I thought this was a miracle)
23) I went inside, and after a while officer came back. We apologized and told her that we came back for I-94s..she said they will retain and wont return..We told her that we are not using EAD and we are still on H1B..she said she will give back..
then she asked, I am sure you didnt come back for I-94 alone, did you get any document?
24) We showed her the memo.
25) She read that and said I am glad you came back..this clears everything out..I will run this by my supervisor and will see if we can adjust status today

Just an observation - There always seem to be a gap of 2 months between Receipt date and Notice date.
So for July 2nd filers, there notice date would be September 2007. But they all got GC last yr when they made it current till 2006 PD. However processing times arent Sept 2007 even now which makes me believe its the receipt date?

No, it is not always a 2 month gap. Normally RD (on your receipt), the data entry date (you see online as "your case was received on..."), and ND should be in quick succession. It was only in July/Aug 07 when due to high volumes many cases (including mine) waited for data entry for months, as no center wanted to accept that additional responsbility. Those whose cases were entered in July/Aug 07, became ahead of those whose cases were entered in Sept and Oct 07, no matter when they filed or what their RD (as on the receipt). People with PD in 2005 and 2006 who got GC last year were those lucky ones who cases were entered in the system in July, Aug (and may be some in Sept) 07.

Personally, though I had an inkling, I had no idea the situation for even brilliant individuals was so shockingly bad. As a core member of IV if I feel this way, I am sure that the lawmakers have absolutely no idea about how highly qualified yet unfairly treated all of us are.
We at IV have achieved quite a lot of success at DC by meeting many many senators and now atleast they are aware that highly-skilled immigrants are facing issues. Most also know about some org called Immigration Voice which has been making quite some noise since the last couple of months.
We are pretty confident that when our stories passed on to Senators it will definitely benefit us and convey the stark reality. Maybe a jolt like this is what is needed to get them out of stupor
Lets work together to make sure that our sufferings end.

I just received a letter from the person who took my AOS interview
The letter reads like this,

3. Donate what ever we can ( 10 , 20 , 30$ etc..) to our cause in IV .

This is the sad reality. A lot of people applied using sub labor during the June and July fiasco. A lot of people made it through the July 15th deadline by atleast filing a 140 through sub labor.
Now USCIS is processing all these 140s and as they have old dates, they are becoming approvable.
As long as there are visas with old dates approvable - USICS will exhaust them. As long as USCIS exhausts old visas, DOS need not move the dates forward.
RIght, bygones are bygones, we have to move on...no point in sulking about it..:)...cant change it now..move ahead..thats all...;)

2) The EB GC reforms proposed and passed as an amendment in mid-2006 are long overdue!
3) IV has gathered a lot of admiration and attention after the flower campaign/ SJ Rally-> leading to the July VB reversal, and of course the DC rally!
Even if 2500 of them pay $50 a month, IV would have a steady flow of $125000 a month for lobbying efforts.
Just imagine what IV could accomplish in the next few months, if only people realized how important it is for them to sign up for monthly contributions!

4. Had unpaid driving fines. (Bet she didnt have driving insurance either).
She had her delivery in a hospital which automatically assures adequate care for the child (paid for by the good citizens of Maricopa county, i should add).
As long as the pregnancy is uncomplicated, a woman is perfectly capable of delivering with a leg shackled. In no way does that put her at risk of complications.

Articles like this are published primarily to sway public opinion in favor of illegal aliens and amnesty. Judging by the responses I am impressed who effective they are.

50,000 unused visas were given to Schedule A in 2005. When the bill was first introduced the unused visas 100,000+ was supposed to go to EB3 since there was retrogression in just EB3 category and Schedule A was part of EB3.
After debate for a few days 50,000 of these were allocated to Schedule A and the EB3 retrogression was forgotten and never been fixed since.
Hope this doesn't happen again.
There are around 100,000 unused visas...am not sure if anyone takes UCSIS to court if these can be reallocated.

its unbelievable what attitude some have on here...many on here are anti-illegal immigration which is understandable...but how can you condone such inhumane treatment...we are not animals...illegals are economic refugees in a way
just cause most of us on here were blessed to come up in decent families who afforded our education...it doesnt give us a right to treat the less fortunate with no dignity...what a shame
