Wanted to find out about the visa options for my wife�she will be coming to the US on an H4 visa�can a company hire her on an L1 or any other kind of visa or does she have to wait for an H1B until the next year quota opens up�She has an MBA Finance degree from Mumbai university & currently working with a multinational bank as a credit analyst�Kindly Respond.

Change this title to december06 marathon.
We should have one marathon every month and there will be members willing to contribute $20 every month. By changing the title to december marathon, we would psychologically make people to get ready for every month. This way, we do not have to put effort every time to members think about contributing.
Contributing will become their routine part of thinking and also $20 is not a big deal for our cause.
I am ready for $20.00 every month from now on. THere will be lot of guys like me and the change in title will make it happen by creating this title every month and keeping it on home page/top.

I really don't understand why people think I am lying????
When I read the memo, I was more worried about my name check and whether she would check the status of it than about this, as anyhow my dates are not current. After showing the memo, she did offer to check the status.
With all the experience our guys have with USCIS officers and staff, it's hard to belive an IO would be that helpful? But, she's and even the staff at this office is not as bad as others have experienced.
I was even telling my wife about the behaviour and how staff at other offices behave.
Which USCIS Center did you go to. The best thing here would be that someone else also go to the same USCIS Center and can hopefully talk to the same IO officer. If she shows the memo again then we can get more information out of it.

Your I-140 was approved in NSC and NOT in TSC. My observation is STRICLTY for people whose I-140s have been approved in TSC but have applied their I-485 in NSC.

Have you tried contacting post-docs (usually EB1 or EB2 NIW, non-IT folks) at universities pursuing research who are affected by retrogression. I think you can find a lot of people on the IIT forums that float around the web. I am sure we can find really successful(well almost) with sorry stories and restrained in career advancement due to EB retrogression.

next, I am in a similar 'somewhat out of status' position myself. i am filing for i-140/i485
I have been with the same employer since Jan 2004, and have every pay stub since then. However during some time in 2006, the company was in deep trouble, management takeover etc. and we were only paid for time spent on a major project (which was the cash cow). Because i was not directly involved in it, I was paid at about 50%, but every week, which lead my final W2 for 2006 to be around 76% of the total on the LCA. I looked at my paystubs and the total weeks at less than 100% is 5 months.
For 2004, 2005 and 2007 (on course) I am on course for my full salary. Also I got a bonus and stock options as the project took off and we are all in a better shape and my 2007 W2 should be higher.
Before 2004, I was a student on a F1 (MS degree) with one h1 in the bad days of 2002. However, my change of status was on the dot.. i.e. i got laid off on a friday and i filed my change of status to f1 the same day. My h1 visa was stamped in 2004 in India. My H1 was extended in early 2007
I am filing a self-sponsored I140. So, my question is:
1) Should I wait for 2008/whenever to file my i485 and hopefully show one year w2 and try to see if that goes through?
2) Try to convince my employer to pay me the back wages for 2006 (they may agree) in lieu of some future pay cut or paid out vacation or trade my stock options. File an amended return with a new 2006 W2 (what are the risks of an audit??)
3) Try to wait till 2008, stamp my visa extension and then file for i-485 showing only 2007 w2.

Please see one of the replies I have above in response to another post. You employer could not pay you, but it is not your fault. If a RFE comes up, you can file affidavits to that effect. You have to consult a good lawyer.
If you are not going to be leaving the US, you shouldn't have to worry about the H1 stamp because you should be getting a new I-94 with your H1 extension approval notice.

Granted Native Americans were here first but at that time America was just a land inhabited by people and it was not a nation. A nation is defined as having the following characteristics (These are UN definitions)
1. Has space or territory which has internationally recognized .
2. Has people who live there on an ongoing basis.
3. Has economic activity and an organized economy. A country regulates foreign and domestic trade and issues money.
4. Has the power of social engineering, such as education.
5. Has a transportation system for moving goods and people.

In the bad economy if everyone can get EAD it will help more. All we need is an admin fix to allow filing of I485 and get EAD benefits

Friend - Why don't you wait till 9/18 and have this discussion. Oh, hold on, by that time, the rally will be a huge success and you won't be around here to show your face. Strength is in numbers and you will see the power of immigrants on 9/18. If we could reverse a visa bulletin with a rally of 350+ members and couple of hundred flowers, we will be headlines with 10000+ rally. This is going to be a historic event and why don't you take our side and be part of history instead of being an anti-immigrant cry baby.

There are only a handful who are active. EB3's are screwed so bad that they have resigned to fate or comtemplating using AC 21 and reapplying in EB 2. i have tired pointing it out to many that EB 3 as a whole is in the same boat, few care and the July filers are happy in the land of EAD/AP.
Some people like me who really love what they do and dont prefer changing jobs have reached a point where they are begining to think if it is all even worth the wait. You will not find a sleeping giant, rather a depressed giant overrun by a bunch of koolaid drinkers.

From the following information:
1.Grant GC to all EB 2 / 3 class pimary applicants who have completed 8 years of continuous stay in the USA without any criminal record.
Personally, I do think the above bill you requested in the #1) is extremely difficult to work. It is because there was a bill proposed to the EB-2/EB-3 applicants to occupy the annual DV-lottery of 55,000 quota but it is NOT becomed a law yet. Now is April, 2011 and the DV-lottery results of this year will be announced soon online and the coming year of DV-lottery will be drawn again later during this coming Oct, 2011 but there is still NO hope to give those EB-2/EB-3 applicants into this DV-lottery quota. If this quota is occupied by EB-2/EB-3 applicants, less applicants will be in GC line.
Also, there is a proposed bill to allow foreign US accreditated universities' advanced graduates of STEM and with a US job offer to have GC but again it is NOT becomed a law yet. Also, your proposed EB-2/EB-3 applicants who have continuous stay of 8 years in US without criminal record to have GC may not fit the requirement of US needed because some of these EB-2/EB-3 applicants are NOT graduated in US universities and some of them are NOT in Science, Medicine, Engineering and Techology academic major which US society in demand.
Last time I have read some other online news or forum, it talks about there is guy who was graduated in a US university with double Master degree---one is M.Sc in computer science and the other is MBA and he still get stuck in getting his first new H-1B visa and later he decided to back home without choice. Yesterday I have read some other online news or forum, it talks about some people who graduated in US Ph.D or doctorate degree in Science/Engineering/Medicine cannot get the GC or some of them get stuck in his or her first new H-1B visa application (due to quota was full or from other reasons) or get stuck in the H-1B visa renewed. So without H-1B visa, how can they get into the EB line for GC?----They are all US graduates and have stayed in US for more than 6-8 years to study with social security card and drivers' licenses and without criminal record !!!!!!!!!!!!!
So you can see if your requested bill in #1) is working, so how about those who graduated in US university in Advanced degree of Science/Medicine/Engineering with US job offer or without H-1B visa?------They are US STEM graduates and have stayed in US with 6-8 years either study or work without criminal record (and with social security card and drivers' licenses)
Personally, I do believe since US demand Science/Medicine/Engineering (STEM) type people and also need the inflow of money to rescue the national debt, so why don't allow those US STEM type graduates get the GC and bring the money to immigrate to start up companies to create job opportunities and to buy houses. Then the non-STEM graduates who want to stay in US can also go into the second path of immigration such as bring money to set up companies to hire 3-6 persons for better economy. The DV-lottery can open to any US STEM graduates to enrol online by " first come, first get" basis and if once annual immigration quota of 55,000 is filled, those graduates need to wait for another year to enrol online for immigration. So every STEM or non-STEM graduates bring money to start companies in US creating job opportunities, paying taxes and bring inflow of money----better economy is growing up.
Moreover, those graduates will invite friends/relatives to visit US, increasing sales of both international and dosmetic airline tickets, hotel reservations, restaurant reservations and uplift the profits all kinds of retail businesses. Tourist visa fees will also add monetary income. Overall, inflow of money and jobs creation are dual powers to uplift the economy.
With inflow of money from immigration, there is NO government shutdown and there is NO hiking taxes needed for the existing US companies.
Also, in Australia, it allows foreign graduates who have stayed in Australia for over 5 years and without criminal record to get the GC automatically

Now is April, 2011 and the DV-lottery results of this year will be announced soon online and the coming year of DV-lottery will be drawn again later during this coming Oct, 2011 but there is still NO hope to give those EB-2/EB-3 applicants into this DV-lottery quota. If this quota is occupied by EB-2/EB-3 applicants, less applicants will be in GC line.
Also, there is a proposed bill to allow foreign US accreditated universities' advanced graduates of STEM and with a US job offer to have GC but again it is NOT becomed a law yet. Also, your proposed EB-2/EB-3 applicants who have continuous stay of 8 years in US without criminal record to have GC may not fit the requirement of US needed because some of these EB-2/EB-3 applicants are NOT graduated in US universities and some of them are NOT in Science, Medicine, Engineering and Techology academic major which US society in demand.
Last time I have read some other online news or forum, it talks about there is guy who was graduated in a US university with double Master degree---one is M.Sc in computer science and the other is MBA and he still get stuck in getting his first new H-1B visa and later he decided to back home without choice. Yesterday I have read some other online news or forum, it talks about some people who graduated in US Ph.D or doctorate degree in Science/Engineering/Medicine cannot get the GC or some of them get stuck in his or her first new H-1B visa application (due to quota was full or from other reasons) or get stuck in the H-1B visa renewed. So without H-1B visa, how can they get into the EB line for GC?----They are all US graduates and have stayed in US for more than 6-8 years to study with social security card and drivers' licenses and without criminal record !!!!!!!!!!!!!
So you can see if your requested bill in #1) is working, so how about those who graduated in US university in Advanced degree of Science/Medicine/Engineering with US job offer or without H-1B visa?------They are US STEM graduates and have stayed in US with 6-8 years either study or work without criminal record (and with social security card and drivers' licenses)
Personally, I do believe since US demand Science/Medicine/Engineering (STEM) type people and also need the inflow of money to rescue the national debt, so why don't allow those US STEM type graduates get the GC and bring the money to immigrate to start up companies to create job opportunities and to buy houses. Then the non-STEM graduates who want to stay in US can also go into the second path of immigration such as bring money to set up companies to hire 3-6 persons for better economy. The DV-lottery can open to any US STEM graduates to enrol online by " first come, first get" basis and if once annual immigration quota of 55,000 is filled, those graduates need to wait for another year to enrol online for immigration. So every STEM or non-STEM graduates bring money to start companies in US creating job opportunities, paying taxes and bring inflow of money----better economy is growing up.
Moreover, those graduates will invite friends/relatives to visit US, increasing sales of both international and dosmetic airline tickets, hotel reservations, restaurant reservations and uplift the profits all kinds of retail businesses. Tourist visa fees will also add monetary income. Overall, inflow of money and jobs creation are dual powers to uplift the economy.
With inflow of money from immigration, there is NO government shutdown and there is NO hiking taxes needed for the existing US companies.
Also, in Australia, it allows foreign graduates who have stayed in Australia for over 5 years and without criminal record to get the GC automatically

My american employer rejected to file PERM after ads are posted. They were supposed to befiling in EB3 and they said they found candidates so they are not going to file green card...I am totally depressed..This is the true picture in almost all american companies. BEWARE of green card.
